CC&R stands for covenants, conditions and restrictions – the governing documents for the operation of the POA. These are limits and rules placed on our group of homes and condominiums complex by the neighborhood association. When living in a home or condominium that is restricted by CC&Rs, an owner gives up certain freedoms in order to be part of a shared community. These are the rules that homeowners, tenants, and guests are obligated to follow.
CC&Rs differ from bylaws, which define how the POA will function. CC&Rs focus on homeowners’ responsibilities, restrictions on how they can use their property, maintenance requirements, and other obligations.
CC&Rs are publicly recorded in the county records office. This makes them legally binding and difficult to change. Bylaws are not publicly recorded, and they do not need to be in order to be legally binding.
